A Chicago injury attorney is suing on behalf of Chicago-area resident Mollie Ralph over injuries she sustained during a concert promotion on Aug. 7, 2009 after a drunken brawl broke out at a Brad Paisley concert. I'm going to go out on a limb and guess this isn't the first time an alcohol-induced fight has erupted at a country music show.
She claims to have suffered from serious and costly injuries that caused her "pain and disability and disfigurement," all of which she says are permanent in nature.
In her complaint by her Chicago injury attorney over at Jamie M. Trapp & Associates, the complaint details that Live Nation was negligent when "the alcoholic liquors consumed by these certain individuals caused or contributed to cause in their intoxication."
So the plaintiff blames Live Nation for providing too much alcohol to the wrong people. Clearly, it was up to the bartenders to decide who to give drinks to?
The complaint also details how the promoter should have provided more security and should have properly broken up the fight once it occurred.
The concert took place at First Midwest Amphitheater in Tinley Park, which the complaint indicates is owned by Live Nation. Since alcohol was served at the venue and Ralph claims the alcohol led to her injuries, her complaint invokes Illinois' Dram Shop Act, which extends liability for injuries to institutions that sell alcohol.
She's asking for more than $50,000 in damages. For more information about dram shop laws, please visit our Related Resources.
